You retain ownership of your User Content as between you and DiyLabs.ai. You remain responsible for all decisions, actions, compliance obligations, and outcomes resulting from your use of AI-generated outputs or automation features.

No output should be interpreted as professional advice or as a substitute for advice from a suitably qualified professional. You are responsible for consulting qualified professionals where required and for independently verifying outputs before using them in any regulated, high-stakes, legally sensitive, or safety-critical context.

If you exceed your plan limits, features may be throttled, paused, restricted, or require an upgrade. Repeated excessive, abusive, automated, or abnormal usage may result in suspension or termination, including on paid plans.

Unless required by applicable law, all fees are non-refundable. This includes unused subscription time, unused credits, partial billing periods, accidental purchases, non-usage, dissatisfaction, changes in business needs, or failure to cancel before renewal.
You are responsible for reviewing plan details, pricing, limits, renewal terms, and available features before purchasing.

You may request account closure. Certain records and data may be retained where required by law, necessary for accounting or tax obligations, needed to resolve disputes, prevent fraud, enforce agreements, or protect legitimate business interests.

12. Intellectual Property and Platform Ownership

Except for the limited, revocable, non-exclusive, non-transferable right to use the Services during an active subscription and in accordance with these Terms, no rights are granted to you.
You may not copy, reproduce, modify, resell, sublicense, distribute, reverse engineer, decompile, extract, or otherwise exploit the platform or any part of it unless expressly permitted in writing by Globeria Consulting GmbH or required by applicable law.
We may use feedback, suggestions, recommendations, or ideas you provide to improve the Services without payment or obligation to you, provided that we do not publicly attribute such feedback to you without permission.

You are responsible for assessing whether outputs may violate third-party intellectual property rights, privacy rights, confidentiality obligations, contractual restrictions, advertising rules, platform policies, or other applicable requirements.

14. Enforcement, Suspension, and Termination

We also do not guarantee any specific business outcome, including search rankings, revenue, conversions, sales, productivity gains, cost savings, traffic, engagement, or performance improvements resulting from the use of AI-generated content, automation features, integrations, or other Services.

- No guarantee of accuracy, legality, or suitability of AI outputs.
- No guarantee of SEO rankings, conversions, revenue, or business results.
16. Limitation of Liability
To the maximum extent permitted by applicable law, Globeria Consulting GmbH, its directors, officers, employees, contractors, affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages.
This includes loss of profits, revenue, savings, data, goodwill, reputation, business opportunities, anticipated benefits, or business interruption arising from or related to your access to, use of, inability to use, or reliance on the Services.
Our total aggregate liability for any claim arising from or related to the Services will not exceed the amount you paid to Globeria Consulting GmbH for the Services during the 30 days immediately preceding the event giving rise to the claim, unless applicable law requires a different liability standard or does not permit such a limitation.

17. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Globeria Consulting GmbH, its affiliates, directors, officers, employees, contractors, licensors, service providers, and partners from and against claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable legal fees, arising out of or related to:
- Your access to or use of the Services.
- Your User Content, prompts, files, data, or uploaded materials.
- Your violation of these Terms or applicable law.
- Your infringement or alleged infringement of third-party rights.
- Your publication, distribution, or use of AI-generated outputs.
- Your misuse of automation features, integrations, or external services.
This includes claims involving intellectual property infringement, privacy violations, data protection violations, unlawful publication, deceptive content, breach of confidentiality, or harmful automation activities resulting from your use of the Services.
18. Governing Law and Jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law principles.
Where legally permitted, the courts responsible for Magdeburg, Germany, will have jurisdiction over disputes arising from or relating to these Terms or the Services.
If you are a consumer, mandatory consumer-protection laws and jurisdiction rules applicable in your country of residence remain unaffected.
